AVANT GUARD PRO COATINGS (“AG”)

LIMITED WARRANTY

FORMULA 1051 (“Product”)

General Terms, Limitations & Conditions

The following general terms, limitations and conditions apply to the Product (“Avant Guard Formula 1051” and/or “AG Formula 1051”):

• Warranty term begins from the date of registration of warranty via website, warranty card/booklet, and vehicle details and extends for a period of 10 years from the date of registration subject to the conditions herein (“Warranty Period”).
• This Warranty does not apply to and expressly excludes any application to commercial vehicles or vehicles used for commercial purposes at any time previous to, presently, or during the course of this warranty period.
• For this Warranty to be valid the initial application must be performed by an AG certified installer.
• Any application, re-application, repair work or other work carried out on the coated surface must be applied, reapplied, or repaired by a Certified AG installer after any warranty claim is approved by AG.
• AG may only approve claims under this Warranty.
• AG must be notified of any claim due to failure of product performance within thirty (30) days of occurrence and failure to provide timely notice will constitute a release and waive of all rights herein at the option of AG.
• Prior to application of the Product to any vehicle machine polishing of the surface of the vehicle must be completed applicator prior to application.
• Product must be applied in accordance with guidelines and specifications published by AG.
• Vehicle must remain continuously registered with AG Pro Coatings for the duration of the warranty in the name of the original applicant. Warranty is non-transferable.
• Warranty is in the name of the vehicle owner and Warranty is non-transferable for any reason.
• AG’s obligation under this Warranty is limited to the owner of the Vehicle at the time the Product is applied and is not assignable.

Limited Warranty

Subject to the terms and provisions hereof and during the Warranty Period, AG warrants that the Product if properly applied and maintained will protect the subject warrantied vehicle’s paint from damage caused by oxidation, bird droppings, bug splatter, tree sap or ultraviolet sunlight/exposure (“Covered Events”) while being maintained in accordance with the terms and conditions of this Warranty. In the event of a Covered Event, AG agents will at no cost to the owner repair, clean, and/or retreat the affected area. AG’s sole and limited obligation herein is to have the Product reapplied and/or any alleged defect in the Product repaired and/or to refund the amount paid solely for the Product. AG is not liable for special, consequential or incidental damages or losses.

General Liability Limitations

• Workmanship errors and faulty workmanship such as high spots, streaks, and low spots are not covered.
• Deterioration of factory-installed equipment including paint or any other treated part of substandard specification, materials or workmanship by vehicle manufacturer, their dealership, third-party supplier or modifier, or professional detailers not authorized by AG.
• Swirl marks, marring, scratches, scuffs, scrapes, chips to the painted surface, hard water spots existing prior to the date of application and which cannot be removed by the installer prior to installation.
• Pre-existing damage or deterioration to any surface to which the Product is applied and/or any claim for matters which are covered by vehicle manufacturers’ warranty.
• Damage caused by manual or automatic wash brushes, contaminated and/or abrasive cloths and sponges, untreated areas due to accident damage and/or their subsequent repairs, and/or damage caused by impact with a foreign object (i.e., stone chips).
• Warranty excludes any non-clear-coated or matte finishes, extreme weather conditions, secondary effects that may result from the foregoing, or any other force majeure.
• Loss or damage caused by road salts and chemicals and/or overspray or other exposure to paint.
• Owner’s failure to repair and re-treat surfaces subject to accident damage in accordance with the warranty.
• Damage caused by any alteration or modification to the vehicle surfaces.
• Damage caused by manufacturer’s defects.
• Damage to the vehicle prior to product application as disclosed or documented by the AG installer.
• Failure to adhere to any requirements listed under the “General Terms and Conditions.”
• Damage or structural failure occurring as the result of racing applications or willful abuse of Product and/or vehicle upon which it is applied.
• Damage caused by or arising from either accidental or malicious acts of the Owner and/or third parties, including but not limited to fire, flood extreme weather condition and secondary events that may result from any of the foregoing and/or force majeure.

Financial Limitations

In the event of a warranty claim, this warranty and AG’s obligations under this warranty are expressly limited to the following maximum amounts at AG’s sole option and discretion:

1. AG or its agents shall arrange the necessary approvals for warranty repairs and coating reapplication to be carried out, or;
2. Pay the owner of the warrantied vehicle a maximum amount of $2,000 or the cost of coating application (whichever is less) in full and final settlement of the customer’s claim under this warranty.

Under no circumstances is AG liable or responsible for special, incidental or consequential damages or losses and AG’s financial liability is limited to the amounts set forth herein. To make a claim contact AG and initiate a claim through www.agprocoatings.com.

General Warranty Invalidations

In addition to any other term, condition or limitation within this Warranty, this Warranty will be deemed null and void in the event of one or more of the following: transfer of ownership of the vehicle to which the Product is applied; failure to maintain the vehicle according to the standards and techniques recommended by AG; use of abrasive compounds and polishes and third-party products not approved by AG or an AG certified installer; collisions, accidents or other physical damage or loss to the vehicle or vehicle surfaces.
